Terms of Service

1 The agreement

These Terms of Service (the “Terms”) govern your access to and use of the BuyWise Home websites, report request forms, document upload tools, and the property reports we deliver (together, the “Service”). The Service is operated by Vantage Point Data LLC, a Georgia limited liability company (“BuyWise,” “we,” “us”).

You accept these Terms by requesting a report, uploading a document, or opening a report we deliver to you. If you are accepting on behalf of a brokerage, employer, or other organization, you represent that you have authority to bind it, and “you” means that organization.

If you do not agree to these Terms, do not use the Service.

2 What BuyWise is — and is not

A BuyWise report is a research and organizing tool. It gathers public records, published datasets, and documents you give us about a single property; it organizes them into plain English; and it points back at its sources so you can check them yourself.

A BuyWise report is not, and must not be relied on as, any of the following:

• an appraisal or opinion of value, and is not prepared by a licensed appraiser or in accordance with USPAP;
• a home inspection, and does not involve anyone physically visiting, entering, or examining the property;
• a survey, boundary determination, title search, title opinion, or title insurance commitment;
• an environmental site assessment or Phase I/II report;
• legal, tax, financial, insurance, or investment advice;
• a consumer report, investigative consumer report, or consumer credit information as those terms are defined in the federal Fair Credit Reporting Act. See section 5.

Nothing in the Service creates an agency, fiduciary, brokerage, or professional-client relationship between you and BuyWise. We do not represent any party to a real estate transaction.

3 Who may use it

You must be at least 18 years old and able to form a binding contract. The Service is intended for use in the United States and for U.S. properties; we make no representation that it is appropriate or available elsewhere.

Some parts of the Service are offered to real estate professionals. Where a form asks you to confirm that you are requesting a report in a professional real estate capacity, that confirmation is a representation to us, and we are entitled to rely on it.

You sign in with a one-time link we email you; there is no password. Anyone who can read your email can sign in as you, so keep that inbox secure. You are responsible for everything done through your access to the Service and for keeping report links confidential. Report links are unlisted but are not individually authenticated — anyone with the link can open the report, so treat a report URL as sensitive.

4 Documents you upload

You may upload documents about a property — inspection reports, seller disclosures, repair and concession paperwork, HOA material, and similar records (“Your Documents”). You keep ownership of Your Documents.

The permission you give us

You grant BuyWise a non-exclusive, worldwide, royalty-free licence to host, copy, transmit, process, extract text and images from, analyze, and display Your Documents, solely in order to produce and deliver the report you asked for and to operate, secure and support the Service. This licence ends when we delete the documents under our retention schedule, except for backup copies that expire on their normal cycle.

What you are promising us

By uploading a document you represent and warrant that:

• you have the right to provide it to us and to have it processed as described in these Terms and the Privacy Policy;
• doing so does not breach a contract, a non-disclosure obligation, a licence granted to you by its author, or anyone's copyright or privacy rights; and
• you have given any notice and obtained any consent required from other people identified in it.

Processing by AI systems

Your Documents are sent to a third-party AI provider for text extraction and classification. See section 6 and the Privacy Policy for what that means in practice.

What you should not upload

Do not upload Social Security numbers, financial account or payment card numbers, government identification numbers, health records, or credentials. If a document you need to share contains them, redact them first. We do not need them and do not want to hold them.

5 Acceptable use

You agree not to use the Service, or anything in a BuyWise report, to:

Make decisions the law reserves for consumer reports

BuyWise is not a consumer reporting agency and a BuyWise report is not a consumer report. You may not use a BuyWise report, in whole or in part, as a factor in deciding a person's eligibility for credit or insurance, employment, tenancy or housing, or any other purpose listed in 15 U.S.C. § 1681b. If you need information for one of those purposes, obtain it from a consumer reporting agency that complies with the FCRA.

Discriminate, or steer

Misuse registry information

Where a report includes information derived from a publicly published state sex offender registry, that information is supplied by the state and is subject to the state's own terms. Most registries prohibit using their data to harass, threaten, or intimidate a registrant or their family, and several impose criminal penalties for doing so. You agree to use any such information only to inform your own decision about a property, and never to commit a crime against, harass, or discriminate against any person. You also agree not to redistribute or resell it.

Or otherwise

• scrape, crawl, bulk-download, or systematically extract the Service or its outputs, or use automated means to request reports;
• resell, sublicense, or republish reports as a data product, or use them to train a machine learning model;
• remove or obscure source attributions, disclaimers, or the “as reported” labelling on quoted material;
• present a report, or any part of it, as an inspection, appraisal, survey, or title product, or as your own work without attribution;
• request a report for a property in order to harass, stalk, or locate a person;
• probe, scan, or test the security of the Service, or circumvent rate limits, paywalls, or access controls;
• upload malware, or anything unlawful; or
• use the Service in violation of any applicable law, including real estate licence law and advertising rules.

6 AI-generated guidance

BuyWise reports are built in two layers, and the distinction matters:

Large language models produce fluent text that can be incorrect, incomplete, internally inconsistent, or confidently wrong. Cost figures, severity characterizations, and recommendations in the guidance layer are estimates and opinions, not quotes, bids, or professional determinations. Repair costs in particular vary enormously by region, contractor, and what is found once work begins.

We deliberately preserve the terminology used by the source document rather than restating it in our own categories, so that a severity term in a report is the term the author actually used. We do not warrant that this is always achieved. If a quoted passage does not match your copy of the original, the original governs — please tell us.

We may change the models, providers, and prompts we use at any time, which may change the wording or emphasis of guidance between reports on the same property.

7 Third-party data and services

The Service compiles information from government and commercial sources, including federal, state, and local agencies and records, mapping and address providers, and commercial real estate, environmental, and other data providers.

We do not control these sources. They may be out of date, incomplete, inconsistent between sources, incorrectly geocoded, or simply wrong; coverage varies by state and county; and a source may change its terms or stop publishing at any time, which may remove a section from future reports. We make no warranty about any third-party data and disclaim liability for it to the extent permitted by law.

Reports and pages embed mapping and other third-party components. Your use of those components is also subject to the provider's own terms — including the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

Any mention of a contractor, inspector, lender, service company, or other business in a report is informational. We do not endorse them, we are not responsible for their work, and you should do your own diligence before engaging anyone. We do not take referral fees, and no business mentioned in a report pays us to be there.

8 Free and paid reports

The free report

Each person may request one free report, which covers the public-data sections of a report but not the sections marked as part of the full report. We count it against your email address (different spellings of the same inbox count once). If a free report cannot be built, it does not use up your free report. Free access may be limited, changed, or withdrawn at any time.

The full report

A full report costs $59 for one property, as a single one-time purchase. It is not a subscription and does not renew. The price shown at checkout is the price you pay; prices exclude taxes unless stated, and you are responsible for any applicable sales or use tax.

You are charged only if your report is delivered. Payments are processed by Stripe; we never see or store your card number. At checkout your card is authorized for $59, which places a temporary hold. When your report is delivered we capture that payment. If we cannot deliver your report — including after we retry automatically when a data source is temporarily unavailable — we cancel the authorization and you are not charged. Depending on your bank, a released hold can take a few days to disappear from your statement.

A report is “delivered” when it is available at its link. A delivered report may leave out a section for which no data exists for that property, or for which a source failed; the report says so where it applies.

Refunds and guarantees

These apply to full reports you paid for. A free report involves no payment, so none of them apply to it. Each paid report qualifies for only one of the remedies below; for example, a report refunded under the 7-day refund cannot also earn replacement reports.

7-day satisfaction refund. If you are not satisfied with a delivered full report for any reason, email hello@buywisehome.com within 7 days of delivery, from the email address you used to buy it, and we will refund the $59 in full.

If your deal doesn’t close: up to 3 more full reports. If your purchase of the property in a paid report does not close, we will give you up to three full reports on other properties at no charge (“replacement reports”).

• What counts: your purchase contract for that property was terminated, withdrawn, or otherwise ended before closing, for any reason, including during your due diligence period. It does not apply if you never went under contract on the property.
• How to claim: email hello@buywisehome.com from the email address you used to buy the report, within 60 days after the contract ended, with one document showing that it ended: a termination notice or mutual release, or a written confirmation from your agent or closing attorney.
• Using them: replacement reports are added to your account and must be requested within 3 months of the date we confirm your claim. Each covers one different property. They have no cash value, cannot be transferred, sold, or exchanged for money, and are not themselves eligible for further replacement reports or refunds.

If BuyWise doesn’t pay for itself 10 times over, it’s free. If the seller concessions you obtain on the property in a paid report are worth less than ten times what you paid for that report ($590 for a $59 report), we will refund what you paid.

• What counts as a seller concession: a seller credit or repair credit at closing, a reduction in the purchase price, or repairs the seller agrees to complete at the dollar amount stated in the signed agreement — in each case agreed in writing after your report was delivered. Concessions agreed before your report was delivered do not count.
• How to claim: email hello@buywisehome.com from the email address you used to buy the report, within 30 days after closing, with your Closing Disclosure or settlement statement and any signed amendment or addendum showing the concessions. If the deal did not close, the guarantee above applies instead.
• What we refund: the amount you paid for that report.

Refund mechanics and limits. Refunds go back to the original card through Stripe and usually appear within 5–10 business days, depending on your bank. We may ask for reasonable additional documentation to verify a claim, and we may decline claims that are incomplete, made outside the time limits above, or part of a pattern of abuse, such as repeatedly buying and refunding reports or submitting altered documents.

9 Intellectual property

The Service, the report format and templates, our software, and the BuyWise Home name and logo are owned by BuyWise or its licensors and are protected by intellectual property law. Nothing here transfers ownership of them to you.

Your licence to a report. Subject to these Terms and to payment of any applicable fee, we grant you a non-exclusive, non-transferable licence to use a report we deliver to you for your own real estate transaction, and — if you are a licensee — to share it with the client for whom you requested it. You may print it and email it to that client, their attorney, and their lender. You may not publish it, post it publicly, sell it, or distribute it as a marketing product without our written permission.

Underlying sources keep their own rights. A licence to a report is not a licence to the third-party documents and datasets quoted in it.

Feedback. If you send us suggestions, we may use them without restriction or obligation to you.

Copyright complaints. If you believe material in the Service infringes your copyright, contact our designated agent, Vantage Point Data LLC, Attn: Copyright Agent, 775 Hampton Pl SW, Marietta, GA 30064, or legal@buywisehome.com with the information required by 17 U.S.C. § 512(c)(3).

10 Suspension and termination

You may stop using the Service at any time and ask us to delete your information as described in the Privacy Policy.

We may suspend or terminate access, with or without notice, if you breach these Terms, if we reasonably believe your use creates legal risk or harms others or the Service, or if we discontinue the Service. Where the reason is not urgent we will try to give notice first. Sections 4, 5, 9, 11, 12, 13, 15 and 16 survive termination.

11 Disclaimer of warranties

12 Limitation of liability

This allocation of risk reflects the price of the Service and the fact that we do not inspect properties. If you need an assurance someone stands behind, commission an inspection, appraisal, survey, or title policy from a licensed professional who carries insurance for it.

13 Indemnification

You will defend, indemnify, and hold harmless BuyWise and its officers, employees, and agents from any claim, loss, liability, and reasonable legal fees arising out of: your use of the Service; Your Documents, including a claim that uploading one infringed a right or breached a duty of confidentiality; your breach of these Terms, of section 5 in particular; your violation of fair housing, FCRA, licence, or registry-use law; or your presentation of a report to a client.

14 Changes

We may change the Service, and we may change these Terms. If a change is material we will update the “last updated” date above and give reasonable notice — by email or a notice in the Service — before it takes effect. Continuing to use the Service after that date means you accept the revised Terms. If you do not accept them, stop using the Service.

Reports already delivered continue to be governed by the Terms in force when they were delivered.

15 Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Cobb County, Georgia. Either of us may instead bring an individual claim in a small-claims court if it qualifies.

Before filing anything, please contact us at legal@buywisehome.com; most problems are faster to fix directly.

If a provision of these Terms is unenforceable, it is severed and the rest stands. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of the business. These Terms, together with the Privacy Policy and any order terms, are the entire agreement between us about the Service.
